Last Updated: 2023-6-3

Welcome to Subvolver's text-to-speech application (the "Service"). The Service is provided by Subvolver.

By accessing or using the Service, you agree to be bound by these terms of service ("Terms"). If you do not agree to all the Terms, then you may not access or use the Service.

Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Use of the Service

The Service is intended for personal, non-commercial use. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Account and Registration

You may be required to create an account and provide certain information about yourself in order to use the Service. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not use someone else's account without permission. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Subvolver and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Subvolver. Subvolver will not use or distribute the audio generated by users through the Service for any purpose.

User Content

You are responsible for your own content and the consequences of posting or publishing it. By posting or publishing content on or through the Service, you represent and warrant that: (i) you have the right to post or publish the content and grant Subvolver the rights granted in these Terms; (ii) the content is accurate and not misleading; and (iii) the use and posting or publishing of the content does not violate these Terms and will not violate any rights of or cause injury to any person or entity.

Subvolver has the right but not the obligation to monitor and edit or remove any content posted or published on the Service.

Termination and Cancellation

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Subvolver makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.

Limitation of Liability

In no event will Subvolver or its affiliates, agents, directors, employees, suppliers, or licensors be liable for any damages whatsoever, including without limitation, direct, indirect, incidental, punitive, and consequential damages, arising out of or in connection with the Service, these Terms, or your use or inability to use the Service, or any other matter relating to the Service. In no event will Subvolver's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Service.

Governing Law

These Terms and your use of the Service shall be governed and construed in accordance with the laws of the State of Minnesota, United States, without giving effect to any principles of conflicts of law.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in the State of Minnesota, United States.

Miscellaneous

These Terms constitute the entire agreement between you and Subvolver regarding the use of the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of Subvolver to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
